User Agreement

By using the Golden Eagle Coins website or any other service provided by Golden Eagle Coins, you implicitly agree to the following Terms of Use. These terms, and those available by hyperlink (the "User Agreement") apply to all orders, purchases, and sales made through www.goldeneaglecoin.com, by telephone, or by any other means.
We urge you to read and understand this User Agreement, as well as all policies and procedures before using any Golden Eagle Coins service. Also, it is necessary that you acknowledge reading, understanding, and accepting all terms of the User Agreement before placing any orders with, or selling to Golden Eagle Coins.
Purchases, Sales, and Orders
You may make purchases, sell, and place orders with Golden Eagle Coins providing that you abide by the Ordering Policy and Procedures.
Disclaimers
Please read all policies and procedures set forth by us including the Disclaimer (available by hyperlink.) By using any Golden Eagle Coins service, including the website, you agree to be bound by the Disclaimer.
You also implicitly state that you have sufficient knowledge and experience on which to base your decisions regarding the buying and selling of precious metals, and that Golden Eagle Coins makes no recommendations about those sales or purchases.  You also acknowledge understanding of the risks inherent in such transactions, including fluctuations in market price, and that those risks are beyond the control of Golden Eagle Coins.
By using any Golden Eagle Coins service, you also acknowledge that certain market conditions or other disruptions such as technological difficulties may result in you being unable to buy or sell any products on a timetable or at a price that is acceptable to you.
If you fail to abide by the terms described within the User Agreement, Golden Eagle Coins may suspend or terminate your account at any time.  The suspension or termination of your account will not affect any of your obligations as they are described in the User Agreement.
Risks
All investment includes an element of risk.  The value of bullion coin is constantly affected by a variety of factors including market price, the perceived value of such coins in relation to their availability, as well as other innumerable factors.
Because of the natural fluctuations in price, investing in bullion and coins may not be suitable for everyone.  It is in your best interest to learn as much as you can, fully understand the market, and ensure you have sufficient financial reserves before considering any investment.
Indemnification
By using any of our services, you agree that Golden Eagle Coins and its affiliates, directors, officers, and shareholders cannot be held responsible or liable for any costs, damages, expenses, liabilities, or obligations you incur as a result of or in connection with any breach of agreement made by you to Golden Eagle Coins, or your failure to adhere to the Terms of Use laid out within the User Agreement.
Limitation of Liability
By using any of our services, you agree that if Golden Eagle Coins is determined to be liable to you in connection with any transaction between you and us, that liability is limited to either the amount which you paid during the transaction or $100; whichever is greater.  We cannot be held liable for any consequential, exemplary, or indirect losses or damages you may incur.
Privacy
Our privacy policy is available by hyperlink and, as with all of our policies, we encourage you to read and understand it before using any of our service.
Other Policies
We may, from time to time, adopt other policies regarding our website, our services, or sales and purchases by Golden Eagle Coins.
All policies are subject to change at any time and all such changes will be effective immediately upon posting to the Golden Eagle Coins website.
Termination
Either you or Golden Eagle Coins may terminate this User Agreement at any time with written notice to the other party.
Termination will not affect the rules and rights available to you or Golden Eagle Coins in regard to use and transactions which occurred before the termination.
Default; Rights and Remedies
Upon your failure to comply with any obligations to Golden Eagle Coins, we will have any and all rights available to us, not limited to those described within the User Agreement.  Golden Eagle Coins may also use any of your funds that it currently holds to satisfy your financial obligations to it.  In addition, Golden Eagle Coins may offset any of its financial obligations to you against your obligations to it.
Your account may also be turned over to a collections agency or to a lawyer for collection.
No delay or failure to act on our part can be construed as a waiver of any right or remedy.  Also, no action upon any right or remedy will limit further exercise of that right or remedy, or any other.
By using any Golden Eagle Coins service you agree to allow us to charge the credit card you have provided for any market losses incurred by Golden Eagle Coins, including cancellation fees, as a result of your failure to fulfill any obligation.
Bullion Market Loss Policy
In regard to purchasing from Golden Eagle Coins, the price offered to you is locked and the transaction cannot be cancelled once a confirmation number has been issued.  The only option is to offset at the current asking price.  You are responsible for paying any deficit between the price at which we sold to you and the offset price.  In regards to selling to Golden Eagle Coins, the offered price is locked and the transaction cannot be cancelled once a confirmation number has been issued.  The only option is to offset at the current buying price.  You are responsible for paying any deficit between the offered price and the offset price.  A $35 cancellation fee will be charged for all cancellations.
Any market gain as a result of cancellations belongs to Golden Eagle Coins.
Absence of Relationship
Upon using any Golden Eagle Coins service, the only relationship that exists between you and us is that of a buyer and a seller.  No other relationship exists or is implied.
Assignment
Our written consent is required before you may transfer or assign this User Agreement, any rights it grants you, or any obligations to another party.  This User Agreement will be considered binding on any allowed transfer or assignment and any successors of Golden Eagle Coins.
Costs and Expenses of Collection
In the event that your account is turned over to a collections agency or a lawyer for collection, you become responsible for paying all costs associated with the collection.  Dispute Resolution
It is our goal that all disputes can be resolved in a timely fashion. To that end, use of any Golden Eagle Coins service requires that you agree to dispute resolution as outlined below:
Forum Selection
The Federal and State courts of Maryland shall have jurisdiction in any disputes.  Those disputes must be resolved within those courts. By using any Golden Eagle Coins service, you agree to waive any objection to the jurisdiction of those courts.
Governing Law
This User Agreement shall be governed and interpreted in agreement with the laws of Maryland.
Waiver of Jury Trial: Arbitration
BOTH GOLDEN EAGLE COINS AND YOU WAIVE YOUR RIGHT TO TRAIL BY JURY AND THE RIGHT TO ARBITRATION IN THE EVENT OF ANY DISPUTE.
Liability
Failure to perform or delay in the performance of any of our obligations due to events that are beyond our control is excusable, and Golden Eagle Coins cannot be held responsible or liable for any losses or damages which occur because of such events.
Further Assurances
By using any Golden Eagle Coins service, you agree to complete and provide any other reasonable documentation or actions which may be required.
Notices
All communications with us must be through an authorized agent of Golden Eagle Coins LLC in the state of Maryland. All communications to you will be sent to the mailing address, or e-mail address you provided upon registration.
Absence of Waivers
Any failure or decision not to take action in response to any of your failures to comply with the User Agreement does not affect the ability of Golden Eagle Coins to act upon any other such failure.
Section Headings
The section headings used in this agreement are intended to make the document more easily understood.  They do not, and cannot affect the interpretation or the scope of the User Agreement.
Severability
If any term of the User Agreement is found to be unenforceable under the applicable laws, it does not affect the enforceability of any other term.
Amendment
We reserve the right to change this User Agreement at any time.  Any changes will be posted on the Golden Eagle Coins website and, except when otherwise noted; all changes will take effect 30 days after their posting.
This User Agreement cannot be changed in any other fashion except by mutual, written agreement between Golden Eagle Coins and you.
Entire Agreement
This User Agreement sets forth the entire agreement between Golden Eagle Coins and you in regards to the material contained within it.
